Notice Of Passing Of A Zoning Bylaw

By The Municipality Of Hastings Highlands

Take Notice that the Council of the Corporation of the Municipality of Hastings Highlands passed Bylaw 2021-058 on December 1, 2021 under authority of Section 34 of the Planning Act, R.S.O. 1990, c. P. 13.

This zoning bylaw amendment provides for an amendmentas follows:

  1. That Comprehensive Zoning Bylaw No. 2004-035, as amended, is hereby further amended as follows:

Part of Lots 17 and 18, Concession 9, being Part 1 on Plan 21R-26032 in the Geographic Township of Monteagle from the Marginal Agriculture (MA) Zone to the Special Rural Residential – 109 (RR-109) Zone.

Notwithstanding any provision of this Bylaw to the contrary, on lands zoned Special Rural Residential – 109 (RR-109) Zone, the following special provisions shall apply:

i)          Required Yards

            Front Yard (minimum):                                91 metres

            North Interior Side Yard (minimum):         113 metres

            South Interior Side Yard (minimum):        300 metres

            Rear Yard (minimum):                                68 metres

ii)         That the required front yard, interior side yards, and rear yard setbacks be maintained in an undisturbed natural state.

iii)        Notwithstanding ii) above, That one (1) driveway access corridor be permitted to access the building envelope from the road.

The Environmental Protection (EP) Zone is to remain the same.

  1. That Comprehensive Zoning Bylaw No. 2004-035, as amended, is hereby further amended as follows:

Part of Lots 17 and 18, Concession 9, save and except Part 1 on Plan 21R-26032 in the Geographic Township of Monteagle from the Marginal Agriculture (MA) Zone to the Special Rural Residential – 114 (RR-114) Zone.

Notwithstanding any provision of this Bylaw to the contrary, on lands zoned Special Rural Residential – 114 (RR-114) Zone, the following special provisions shall apply:

i)          Required Yards

            North Interior Side Yard (minimum):         260 metres

            South Interior Side Yard (minimum):        94 metres

            Rear Yard (minimum):                                520 metres

ii)         That the required interior side yards and rear yard setbacks be maintained in an undisturbed natural state.

The Environmental Protection (EP) Zone is to remain the same.

And Take Notice that an appeal may be made to the Ontario Land Tribunal in respect of the Bylaw by filing with the Clerk of the Municipality of Hastings Highlands, 20 days after the day of giving notice (last date to file appeal is December 30, 2021 not later than 4:00 p.m.) a notice of appeal setting out the objection to the Bylaw and the reasons in support of the objection, together with a $1,100.00 fee made payable to the Minister of Finance.  Only individuals, corporations and public bodies may appeal a bylaw to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Lands Tribunal, there are reasonable grounds to add the person or public body as a party.
