Notice of Passing of A Zoning Bylaw by The Municipality of Hastings Highlands

Take Notice, that the Council of the Municipality of Hastings Highlands passed Bylaw 2022-004 (General Provisions) on May 4, 2022 under authority of Section 34 of the Planning Act, R.S.O. 1990, c. P. 13.

Council considered all written and oral submissions relating to the zoning bylaw amendment in making its decision.

This zoning bylaw amendment provides for an amendment to the Comprehensive Zoning Bylaw to amend definitions, general provisions, and zoning provisions of Bylaw 2004-035 Comprehensive Zoning Bylaw for all of the lands within the Municipality of Hastings Highlands to conform with the general policies in the County of Hastings Official Plan as approved in August 2018.  The Municipality is required by s.26(9) of the Planning Act to amend the Comprehensive Zoning Bylaw to conform with the Official Plan.

And Take Notice that an appeal may be made to the Ontario Land Tribunal in respect of the Bylaw by filing with the Clerk of the Municipality of Hastings Highlands, 20 days after the day of giving notice (last date to file appeal is June 1, 2022 not later than 4:00 p.m.) a notice of appeal setting out the objection to the Bylaw and the reasons in support of the objection, together with a $1,100.00 fee made payable to the Minister of Finance. 

Only individuals, corporations and public bodies may appeal a bylaw to the Ontario Land Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the bylaw was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Lands Tribunal, there are reasonable grounds to add the person or public body as a party.

A key map is not provided as the zoning bylaw amendment is for all lands in the Municipality.
